Bij betaling met visa/mastercard heeft u 14 dagen herroepingsrecht, dit kan tot 30 dagen duren voordat de terugstorting is verwerkt.

Na 30 dagen, vanaf factuur datum, worden er extra kosten in rekening gebracht met een minimum van 10%

Na 45 dagen worden er administrative kosten in rekening gebracht van 30€ , er komt ook nog een extra toeslag van minimum 10% bij wegens nalatigheid.
Er word ook een aangetekende zending gestuurd.

Na 60 dagen komt er nog een extra toeslag bij van minimum 10% wegens extreme nalatigheid en een administrative kost van 60€

Na 75 dagen word er een administrative toeslag toegevoegd van 120€ en word er een 2de aangetekende zending opgestuurd.

Na 90 dagen word dit voorgelegd voor het gerecht en worden de extra kosten doorgerekend voor de deurwaarder.

indien een factuur niet is betaald word er geen dienstverlening meer geleverd tot dat de factuur betaald is..

Wegens administratieve redenen werken we met Proforma's.

Dit betekend dat het wettelijk GEEN factuur is, maar een soort van offerte.

Na betaling word dit direct omgezet naar een factuur.
U kan uw factuur altijd raadplegen via onze website.

Diensten die op factuur worden gezet en dus achteraf betaald kunnen worden hebben een factuur nummer, Deze zijn WEL facturen.

VPS Data is niet verplicht om met achteraf betaling of op factuur te werken.
Dit is een vrije keuze van VPS Data en geen verplichting, wenst u op factuur kan het zijn dat we er mee akkoord gaan of weigeren om eender welke reden.

U krijgt ALTIJD een factuur na betaling.

BILLING
Products get automatic activated after successful payment , unless a offline payment method is used ( cash/wire transfer )

7 days before due date will you get a notice , this means you have 7 days time to pay the proforma invoice before service get canceled

Services that are avaible to order for 1 year will have a 30 days notice before expiring of the service

There is a 2 day grace period, after those 2 days the service get suspended

Once a service is suspended a fee of 10% will be applied to unsuspend your service (if service is not terminated) , with a minimum fee of 3€

Recurring payments are automatic, a notice still get sended out but will be paid on due date with out the need to pay manual

Recurring payments are optional and not mandatory, every proforma invoice can also be paid manual

Recurring option can be canceled at any time, please contact info@vpsdata.be to cancel it from our side

All services can be canceled at any given moment by requesting a cancelation or by sending a email to info@vpsdata.be

TERMS
All defined terms used below shall have the meanings set forth in our Terms and Conditions. See TOS.

ORDER CANCELLATIONS
Orders that you submit online are processed immediately and can be canceled from the control panel at https://cp.vpsdata.be.

Cancelations refund only the non used time , for example if you buy webhosting with a value of 3€ for 30 days and cancel on the 10th day then you get 2€ back ( 30 days @ 3€ - 10 days = 2€ or 0.10€ per used day)

REFUNDS
After We have received your Cancelation request, We will notify you of the acceptance or rejection of your refund.

If your refund is accepted by us, We will provide a non-transferable merchandise credit or another remedy that we determine in good faith is appropriate in the circumstances.

in some cases is it possible to refund the same way as you paid the invoice ( paypal, 2checkout ... ).

GENERAL
If you do not comply with any of the above conditions, We reserve the right to refuse the return or exchange, or to impose different or additional conditions.

ALL ACCOUNTS ARE SUBJECT TO THE FOLLOWING
The following rules are made and all clients are expected to follow the TOS from VPS Data, the providers of our hosting service.

The Following Scripts Are Forbidden: -IRC Scripts -Bit Torrent Script’s -commercial Advertising

Email: Spamming, or the sending of unsolicited email, from a Site or using an email address or domain that is maintained on a VPS Data account as a reference is STRICTLY prohibited. Accounts in violation of our spamming policy WILL BE DELETED WITHOUT NOTICE. VPS Data will be the sole arbiter as to what constitutes a violation of this provision. All mailing lists should be double opt-in. This means when users on a clients site give their client their e-mail address the user should also have to verify it through e-mail afterwards before anymore mail is sent. This prevents us being listed in spam databases.

IRC: We currently do not allow IRC or IRC bots to be operated on our servers. These include Egg drop bots and TCL scripts.

Use: Any images/tempt to undermine or cause harm to a server, or customer, of VPS Data is strictly prohibited. These images/tempts can include DOS attacks or hacking.

REFUSAL OF SERVICE
We reserve the right to refuse, cancel, or suspend service at our sole discretion. We don’t often do this, only in the event of an out of control script or VPS Data not being able to contact the site owner. VPS Data services may not be used for illegal purposes, or in support of illegal activities. This included and is not limited to hosting of hacking programs, documentation, and or the linking to such illegal files.

VPS Data and our affiliates reserve the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.

HARM TO MINORS
Use of VPS Datas service to harm, or images/tempt to harm, minors in any way, including, but not limited to child pornography or child abuse is strictly prohibited and will result in immediate account termination. We accept adult web sites as long as you use your own material.

THREATS
Use of the VPS Data service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property is strictly prohibited.

HARASSMENT
Use of the VPS Data service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another is strictly prohibited.

FRAUDULENT ACTIVITY
Use of VPS Datas service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes", "ponzi schemes", and "chain letters."

FORGERY OR IMPERSONATION
Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. images/tempting to impersonate any person by using forged headers or other identifying information is prohibited.

UNAUTHORIZED ACCESS
Use of VPS Datas service to access, or to images/tempt to access, the accounts of others, or to penetrate, or images/tempt to penetrate, security measures of VPS Data or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending VPS Data account is subject to immediate termination.

COPYRIGHT OR TRADEMARK INFRINGEMENT
Use of VPS Data service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

COLLECTION OF PERSONAL DATA
Use of VPS Data service to collect, or images/tempt to collect, personal information about third parties without their knowledge or consent.

NETWORK DISRUPTIONS
Network disruptions and unfriendly activity:

Use of the VPS Data service for any activity which affects the ability of other people or systems to use VPS Data Services or the Internet. This includes "denial of service" (DOS) attacks against VPS Data or an individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member’s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their account for illegal or inappropriate actions. A Subscriber may not permit their account, through action or inaction, to be configured in such a way that gives a third party the capability to use their account in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual’s computer system will result in immediate account termination. VPS Data will not tolerate any subscriber images/tempting to access the accounts of others, or penetrate security measures of our server, whether or not the intrusion results in corruption or loss of data.

FRAUD
Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it.

INFRINGEMENT OF COPYRIGHT
Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right:

Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated.

DISTRIBUTION OF VIRUSES
Intentional distributions of software that images/tempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.

LIMITATION OF LIABILITY
VPS Data shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from VPS Datas servers going off-line or being unavailable for any reason whatsoever. Furthermore, VPS Data shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of VPS Data servers. All damages shall be limited to the immediate termination of service.

All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation

DISCLAIMER
VPS Data cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by VPS Data are resold. Thus, certain equipment, routing, software, and programming used by VPS Data may not be directly owned or written by VPS Data. Moreover, VPS Data holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as VPS Data sees fit.

ACCOUNT ACTIVATION
By activating your account with VPS Data, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer Accounts found to be given to minors under the age of 13 will be canceled parents consent required once approved by us we do this by a photo copy of your license.

EXTRA INFORMATION
Furthermore, VPS Data retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

The agreement constitutes the entire agreement between the parties here. The terms and conditions of this agreement shall be interpreted and enforced pursuant to the laws of the Netherlands. Special Rules VPS Data reserves the right to check your account at any time for things that break the TOS. We probably won’t be doing this unless we have a reasonable idea that you are breaking the TOS, but sometimes we will just do checks on random clients, so don't be alarmed if we check you. If you're innocent and aren’t breaking the rules, then you’ve got nothing to worry about!

We do provide a 3 days trial to test out our services

The following rules are made and all clients are expected to follow the TOS from VPS Data the providers of our Web hosting.

1.) Your Not Allowed to place Illegal Porn, Illegal Programs, Warez, IRC Bots, IRC Scripts, Unauthorized Access, No! Sharing Web Space

2.) Adult Porn Is Allowed, we reserve the right to deny any images or text displayed on our web services respect others as they Respect you our accounts are not used for slandering, they are used for business and educational use all adult hosting must comply with The Children’s Online Privacy Protection Act (15 U.S. C. 45), effective April 21, 2000,all websites hosting porn must have a clean public splash page reminding all users that your site requires the age of 18 to view that website, websites found in a non compliance to our TOS may be suspended for your acts that could cost us our web server and customers and possible a law suit.

3.) Backup’s: We do NOT have Backup’s, but your data is protected by RAID 50. You have to make your own backup’s or use our Backup Service

4.) We are not responsible for the loss of income to websites caused by the act of god , hackers, exploits. power outages, hardware failure, virus’s ,down time (etc.).

5.) VPS Data does not collect cookie or user information for the intent to exploit children or sell for profit and complies with the COPPA business act required by FTC.

OUR ACCEPTABLE USE POLICY HAS BEEN DESIGNED TO ENSURE THAT:
VPS Data Acceptable Use Policy ("AUP") is provided to give our customers and users a clear understanding of what VPS Data expects of them while using our service. For simplicity we will refer to VPS Data, all it employees, and interests as VPS Data. All users of VPS Data: those who access some of our services but do not have accounts must comply with this AUP and our TOS (Terms of Service).

Use of VPS Data service constitutes acceptance and agreement to VPS Data AUP as well as our TOS (Terms of Service).

IMPORTANT NOTICE: New orders may take 12-72 hours to set up.

IMPORTANT NOTICE: No back-ups will be given on accounts found to be in violation of our AUP or TOS when your server got suspended.

Most of the rules can be summed up in this statement. If it is against the law or is considered spamming, it is not allowed on our server. Anything that is illegal is not allowed even if we do not explicitly disallow it.

We do not support illegal file sharing. We will only allow music or video files if you are the owner. Please ask before you upload anything that may be in violation with our AUP or TOS.

We support the uncensored flow of information and ideas over the Internet and do not actively monitor subscriber activity under normal circumstances. Similarly, we do not exercise editorial control over the content of any web site, e-mail transmission, newsgroups, or other material created or accessible over or through the services, except for certain proprietary web sites. However, in accordance with our TOS (Terms of Service), we may remove any materials that, in our sole discretion, may be illegal, may subject us to liability, or which may violate this AUP. VPS Data may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing. Your violation of this AUP may result in the suspension or immediate termination of either your VPS Data account or other actions as detailed in Section 3 WITHOUT PRIOR NOTICE. Monthly bandwidth is based on a full month from the date of your account activation, when you used the provided 1gb of bandwidth your site will go temperary offline untill the next month starts.

This document is intended to provide a basic understanding of VPS Data Acceptable Use Policy. The following are guidelines for the establishment and enforcement of VPS Data AUP:

Ensure reliable service to our customers .

Ensure security and privacy of our systems and network, as well as the networks and systems of others.

Comply with existing laws .

Maintain our reputation as a responsible service provider.

Encourage responsible use of the Internet and discourage activities which reduce the usability and value of Internet services.

Preserve the value of Internet resources as a conduit for free expression and exchange of information .

Preserve the privacy and security of individual users .

VPS Data intends to provide its customers access to everything the Internet has to offer. While VPS Data is firmly committed to the principles of free speech, certain activities that may be damaging to the resources of both VPS Data and the Internet and cannot be permitted under the guise of free speech. The resources of the VPS Data and the Internet are limited, and abuse of these resources by one user has a negative impact on the entire community.

We do not routinely monitor the activity of accounts except for measurements of system utilization. However, in our efforts to promote good citizenship within the Internet community, we will respond appropriately if we become aware of inappropriate use of our service.

You may not use your virtual site to publish material, which VPS Data determines, at its sole discretion, to be unlawful, indecent or objectionable. For purposes of this policy, "material" refers to all forms of communications including narrative descriptions, graphics (including photographs, illustrations, images, drawings, logos), executable programs, video recordings, and audio recordings.

If a VPS Data account is used to violate the Acceptable Use Policy or our TOS, we reserve the right to terminate your service without notice. We prefer to advise customers of inappropriate behavior and any necessary corrective action, however, flagrant violations of the Acceptable Use Policy will result in immediate termination of service. Our failure to enforce this policy, for whatever reason, shall not be construed as a waiver of our right to do so at any time.

Onze dienst verlening kan ten allen tijden worden stop gezet zonder dat er een reden nodig is.

Bij stopzetting word het verschuldigd bedrag nog altijd aangerekend.

Een FDM printer is de standaard printer bij VPS Data.
Dit houd in dat we een bepaalde setup hebben om snel en goed te kunnen printen.

We printen op een laag hoogte van 0.16mm met een nozzle van 0.4mm
op aanvraag kan dit worden aangepast

We kunnen niet garanderen dat 2 stukken exact hetzelfde zijn, dit komt omdat er externe factoren zijn waar wij niets aan kunnen doen

We doen ons best om een zo goed mogelijke kwaliteit af te leveren , stukken die niet door de controle geraken worden opnieuw gemaakt, dit kan de nodige vertraging veroorzaken.

Resin printers zijn een soort van hars printers.
Deze werken met lagen van 0.03mm dik om de beste kwaliteit te geven.

Wij werken met een DLP printer voor verbeterde kwaliteit.
Maximum grootte voor een Resin print is 200 mm * 200 mm * 400 mm

We beschikken over het volgende materiaal

Deze filaments zijn moeilijk om mee te printen.
Hierdoor kunnen we ook geen garantie bieden dat ze werken zoals het moet.

VPS Data bied standaard garantie aan op productie fouten.
Deze fouten zijn beperkt tot de manier van printen.
De volgende zaken vallen onder garantie, andere zaken kunnen onder garantie vallen na bespreking.

Prints met Muren dikker dan 2mm die scheuren/breken
Prints die opgevuld zijn en breken/buigen onder normaal gebruik
Prints die worden gebruikt voor de doeleinden waarvoor ze gemaakt zijn maar toch breken.
Productie fouten zoals schuine muren die recht moeten zijn ( en recht zijn op de STL file )

Deze zaken vallen NOOIT onder garantie.

Verkeerd gebruik van de print ( kracht, boren, schuren .... )
Verkeerd materiaal voor de verkeerde toepassing ( pla voor buiten, resin voor mechanische stukken.. )
Filament over verhitten ( Pla tot 40 graden , ASA tot 120 graden... )
Chemisch gebruik ( Chloor, Ethanol, Spiritus,... )
Prints geprint onder niet ideale omstandigheden na overleg ( geen heated chamber, niet uitgehard, geen gedroogd filament,nieuw filament merk ... )

Wat houd garantie nu in ?
Nieuwe onderdelen leveren die de fouten niet bevat.
oplossing zoekt voor de fout en hoe die kan voorkomen worden.

VPS Data protects user information with security measures, however we cannot fully assure the security if hacking attempts succeed.
